Common Drug Crimes in California

Drug Possession

Possessing a small amount of a controlled substance for personal use without a valid prescription is a violation of California Health and Safety Code § 11350.  Simple possession is often charged as a misdemeanor.  You may be eligible for a drug diversion program. 

Drug Possession With Intent to Sell

Possessing large amounts of a controlled substance, or other items indicating an intent to sell such as scales, large cash amounts, or packaging may result in a felony charge with potential prison time and fines. 

Drug Trafficking and Distribution

If you are involved in the transportation, sale, or importation of controlled substances, you may be charged with a serious felony. 

Drug Paraphernalia

Possession of items used to consume or manufacture drugs such as pipes, syringes, or straws is a violation of California Health and Safety Code § 11364.  Possession of drug paraphernalia is often charged as a misdemeanor. 

Drug Manufacturing

Producing, cultivating, or processing illegal drugs, including excessive quantities of marijuana without authorization, may be charged as a felony resulting in prison time and fines.
